AUTOMATION COMPONENTS, INC. TWO (2) YEAR LIMITED WARRANTY

Automation Components, Inc. (hereafter "ACI") makes a two (2) year limited warranty to the purchaser of any product supplied, assembled or manufactured by ACI. ACI warrants that for a two (2) year period, beginning on the date the purchaser receives ACI's product, the product will be free from "defect(s)". The term "defect(s)", means that the components installed in the products supplied by ACI, will be new and free from defects, and that the product will function as described in catalogs, sales brochures, or other materials supplied by ACI. 

    In the event any defect(s) manifests itself or is discovered within the two (2) year period set forth     above, ACI will, at its sole discretion, do one of the following:

    A) Repair the defective product;
    B) Replace the defective product; or
    C) Refund the purchaser, the amount charged to the purchaser by ACI for the original product.          The choice of which of the above remedies will be provided to the purchaser by ACI, pursuant to this Limited Warranty, shall be solely in the discretion of ACI.

*THIS ACI LIMITED WARRANTY IS MADE IN LIEU OF ALL OTHER EXPRESSED OR IMPLIED GUARANTIES AND WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE AND MERCHANTABILITY, AND ANY OTHER IMPLIED WARRANTIES CREATED BY COMMON LAW. ALL CONSEQUENTIAL DAMAGES AND INDIRECT DAMAGES ARE ALSO EXCLUDED BY THIS LIMITED WARRANTY. THIS LIMITED WARRANTY APPLIES ONLY TO THE ORIGINAL PURCHASER OF PRODUCT FROM ACI, AND IS NOT TRANSFERABLE TO THIRD PARTIES. 

    Information in ACI's descriptive literature is based on product specifications that are current at the time of publication. Product specifications, design, and literature will change from time to time, as improvements are introduced and, therefore, do not apply to product shipped before the new literature was disseminated.  All products that are returned to ACI for repair or replacement, must be accompanied by a Return Authorization number, which can be obtained by calling or writing to ACI, prior to returning the product.

All advanced replacements must be issued a purchaser order in writing, by the customer. Once defective parts are returned to ACI, and found to be covered by ACI's warranty, a credit will be issued against the advanced replacement purchase orders, issued by the customer to ACI.

nExclusions

ACI'S TWO (2) YEAR LIMITED WARRANTY SHALL NOT EXTEND TO OR INCLUDE OR BE APPLICABLE TO:

    A. Loss or damage to real property or personal property which is not part of the product covered by this Limited Warranty. 
    B. Any damage to the extent it is caused or made worse by:
        1. Improper maintenance or improper operation by anyone, other than ACI, its employees or agents.
        2. Failure by the purchaser to give notice to ACI of any defects within a reasonable time.
        3. Changes, alterations or additions made to the product, by anyone, after the purchaser takes possession of the product.
        C. Loss or damage which the purchaser has not taken timely action to minimize.
        D. Normal wear and tear or normal deterioration.
        E. Loss or damage not otherwise excluded under this Limited Warranty, which does not constitute a defect in the product, or defective workmanship by ACI, or its employees or agents.
        F. Loss or damage caused by or resulting from accidents, riot and civil commotion, fire, explosion, smoke, water escape, falling objects, aircraft, vehicles, Acts of God, lightning, windstorm, hail, flood, mud slide, earthquake, volcanic eruption, and wind-driven water.
        G. Loss or damages which exceed, in value, or are different from the remedies agreed to be performed by ACI, in subparagraphs A, Band C of the  third paragraph of this Limited Warranty.
        H. Incidental expenses related to inconvenience or relocation during repairs.
        I. Expert fees to determine the cause and extent of the damage.
        J. The cost of temporary repairs.
        K. Loss of use and enjoyment while repairs are being made.
        L. Refinancing costs incurred when additional money is borrowed to do the repairs.
        M. Consequential damages (except where required by State law).
        N. Any product of ACI which has befallen an accident or been improperly installed, after having been acquired by Purchaser.
        O. Any economic loss caused by or arising from the use of ACI's product, will only be covered according to the specific terms and limitations set forth in ACI's Two (2) Year Limited Warranty. No "tort" remedies will be available to purchaser, for any economic loss caused by or arising from products supplied by ACI to purchaser.  Also, NO "implied warranties" will be available to purchaser for any economic loss caused by or arising from products supplied by ACI to purchaser because all such "implied warranties" have been excluded by AUTOMATION COMPONENTS, INC.'S TWO (2) YEAR LIMITED WARRANTY.
